Terms & Conditions

I. General

1.1 These General Terms and Conditions (T&Cs) apply to all photo shoots, bookings and services arranged or provided via the platform mallorca-fotoshooting.com (operated by Chocosite LLC, Florida, USA, hereinafter "Provider").

1.2 By making a booking (in writing, by email or via the website), the client accepts these T&Cs.

1.3 The client's own terms and conditions only apply if confirmed in writing by the Provider.

1.4 These T&Cs also apply to future orders without the need to agree them again.

II. Services and Agency

2.1 The Provider arranges professional photographers worldwide. The shoot itself is carried out by the photographer assigned on location.

2.2 The Provider ensures consistent processing, communication and quality standards.

2.3 Images are delivered digitally via an online gallery.

2.4 Professional image editing includes: removing distracting elements, optimising exposure, adjusting skin tones, straightening horizons and refining the crop. Optional extras such as beauty retouching, make-up corrections or reshaping are available on request for an additional fee.

III. Usage Rights

3.1 Upon full payment, the client receives sole, unlimited rights of use — without restrictions of time or territory — for the delivered images.

3.2 The Provider and the photographers retain no usage rights of their own.

3.3 Use of the images by the Provider (e.g. for social media or advertising purposes) takes place exclusively with the client's prior express consent.

IV. Fees and Payment Terms

4.1 The fee agreed at the time of booking applies.

4.2 Invoices are issued in the name and on account of Chocosite LLC, Florida, USA. No VAT is shown.

4.3 Payment is made by bank transfer to an account specified by the Provider:

• Payment currencies: Euro (EUR) or US Dollar (USD)
• Payment account: European IBAN account in Belgium (bank details provided on the invoice)

4.4 Invoices are due immediately and without deduction.

4.5 In the event of late payment, reminder fees and default interest may be charged.

V. Cancellation and Rebooking by the Client

5.1 Non-appearance at the agreed shoot date does not exempt from the obligation to pay.

5.2 Holiday Shoot: Cancellations are possible up to 14 days before the shoot date. Booking deposits already paid will not be refunded.

5.3 Wedding Shoot: Cancellations are possible up to 4 weeks before the booked date. Booking deposits already paid will not be refunded.

5.4 Late Cancellations:

• Holiday Shoot: Cancellations less than 14 days before the shoot date will result in the full fee becoming due.
• Wedding Shoot: Cancellations less than 4 weeks before the booked date will result in the full fee becoming due.

In both cases, the Provider will endeavour to offer a replacement date within the current season (until 30 October); however, the fee remains payable no later than the originally booked date.

5.5 Illness of the client:

• The client may arrange a replacement date once.
• Refunds of the fee will not be made.
• The fee remains payable no later than the originally booked date.
• The Provider recommends taking out travel or cancellation insurance.

5.6 Vouchers are excluded from the right of withdrawal and are non-refundable.

VI. Right of Withdrawal

6.1 No statutory right of withdrawal exists for individually arranged services (photo shoots).

6.2 No right of withdrawal exists for images already delivered digitally.

VII. Liability

7.1 The Provider is only liable for intentional and grossly negligent conduct.

7.2 Liability for travel to and from the location, weather conditions, local circumstances or items brought by the client is excluded.

7.3 The conduct of the shoot is the responsibility of the photographer assigned in each case. The Provider guarantees the selection of vetted photographers to uniform standards, but assumes no liability for their individual conduct.

7.4 Liability under mandatory statutory provisions (e.g. personal injury) remains unaffected.

VIII. Final Provisions

8.1 Amendments and additions must be made in writing.

8.2 Should any individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall not be affected.

8.3 The place of jurisdiction, to the extent permitted, is the registered office of Chocosite LLC, Florida, USA.
